Auction Terms & Conditions (Artwork Sales)

Effective Date: April 1, 2026

1. Acceptance of Terms

By registering, bidding, or participating in any auction on this website, you agree to be bound by these Terms & Conditions. If you do not agree, do not participate.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement.

3. Nature of Items (Artwork Disclaimer)

All items are original acrylic paintings on canvas unless otherwise stated.

Each artwork is unique and may include natural variations such as:

  • Brush texture
  • Minor imperfections
  • Variations inherent to hand-painted works

These are not considered defects.

4. Image & Color Accuracy

We make reasonable efforts to display artwork accurately. However:

  • Colors may vary depending on screen settings and lighting
  • Scale and proportions may appear different in images

Exact color and appearance are not guaranteed.

5. Condition of Artwork

All artwork is sold as is with no warranties unless explicitly stated.

By bidding, you confirm that you have reviewed all images and descriptions and accept the condition of the artwork.

6. Binding Bids

  • All bids are legally binding
  • Bids cannot be withdrawn once placed
  • The highest valid bid at auction close wins

Do not bid unless you intend to complete the purchase.

7. Payment Terms

  • Full payment is due within 72 hours of auction close
  • Accepted payment methods:
    • Major credit and debit cards (Visa, Mastercard, American Express, etc.)
    • PayPal
    • Bank transfer (ACH or wire)
    • Zelle

If payment is not received within 72 hours:

  • The sale will be automatically canceled
  • The item may be offered to the next highest bidder or relisted
  • Your account may be suspended or restricted

No grace periods are guaranteed.

8. Non-Payment & Resale

If payment is not completed within the required timeframe:

  • You forfeit all rights to the item
  • The seller may resell or relist the artwork without notice
  • You may be held responsible for any loss resulting from resale

9. No Returns / No Refunds

All sales are final.

Returns or refunds will only be considered if an item is materially misrepresented.

Buyer remorse or subjective dissatisfaction is not valid grounds for a return.

10. Taxes

Applicable sales tax will be added where required by law.

11. Risk & Title Transfer

Ownership of the physical artwork transfers upon full payment.

Risk of loss transfers to the buyer upon shipment or pickup.

12. Auction Integrity

We reserve the right to:

  • Reject or cancel bids
  • Remove users
  • Relist items

This includes situations involving suspected fraud, non-payment, or misuse of the platform.

13. Limitation of Liability

We are not liable for:

  • Display or description inaccuracies
  • Misinterpretation of size, scale, or color
  • Shipping delays or carrier-related issues
  • Indirect or consequential damages

14. Governing Law

These Terms are governed by the laws of the State of Colorado.

15. Intellectual Property Rights

Purchase of artwork grants ownership of the physical piece only.

All intellectual property rights remain exclusively with the artist, including:

  • Copyright
  • Reproduction rights
  • Licensing rights
  • Distribution rights

The artist and/or seller retain full rights to:

  • Reproduce the artwork
  • Create and sell prints
  • License the artwork for any use

The buyer may not:

  • Reproduce the artwork
  • Create or sell prints or copies
  • License the artwork
  • Use the artwork commercially
  • Create digital versions, NFTs, or similar derivatives

Any unauthorized use is strictly prohibited and may result in legal action.
